HCCH Webinar: “HCCH 2005 Choice of Court Convention: Fostering Access to Justice for Cross-Border Commerce in the Asia Pacific Region”

 

The Permanent Bureau of the HCCH is pleased to announce that the webinar “HCCH 2005 Choice of Court Convention: Fostering Access to Justice for Cross-Border Commerce in the Asia Pacific Region” will be held this Friday, 22 March, from 16:00 to 17:30 p.m. (Hong Kong time).

The webinar will feature the following topics and speakers:

Conventions & Instruments

On 1 February 2024, the 2007 Child Support Convention entered into force for Canada. At present, 49 States and the European Union are bound by the 2007 Child Support Convention. More information is available here.

CJEU, Case C-566/22, Inkreal v. Dúha reality: Choice of another Member State’s court in an otherwise purely domestic case is sufficient to apply Art. 25 Brussels Ibis Regulation

In its judgment of 8 February 2024, the CJEU had to decide whether “the application of the Brussels Ibis Regulation be based solely on the fact that two parties with their seat in the same Member State agree on the jurisdiction of courts of another EU Member State.”

The case concerned two loans granted to Dúha reality, a Slovak company, by a third party also domiciled in Slovakia, in 2016 and 2017 respectively. Both loan contracts contained an identical choice of forum clause stating that any ‘dispute shall be settled by a court of the Czech Republic having substantive and territorial jurisdiction’. In 2021, the receivables arising from those loan agreements were assigned to Inkreal, another purely Slovak business corporation, who upon non-payment by the debtor brought action in the Czech Republic. Seeking, inter alia, to determine the specific Czech court having territorial jurisdiction, the Czech Supreme Court (Nejvyšší soud) referred the question to the CJEU.

HCCH Monthly Update: July 2022

Conventions & Instruments

On 1 July 2022, the HCCH 2007 Child Support Convention and the HCCH 2007 Maintenance Obligations Protocol entered into force for Ecuador. At present, 44 States and the European Union are bound by the Convention, while 30 States and the European Union are bound by the Protocol. More information is available here.

On 8 July 2022, Pakistan deposited its instrument of accession to the HCCH 1961 Apostille Convention. The Convention, which currently has 124 Contracting Parties, will enter into force for Pakistan on 9 March 2023. More information is available here.

On 13 July 2022, Senegal deposited its instrument of accession to the HCCH 1961 Apostille Convention. The Convention, which currently has 124 Contracting Parties, will enter into force for Senegal on 23 March 2023. More information is available here.

 

Meetings & Events

From 4 to 8 July 2022, the Fifth Meeting of the Special Commission on the Practical Operation of the 1993 Adoption Convention was held online, attended by nearly 400 participants representing HCCH Members, Contracting Parties and Observers. The meeting resulted in the adoption of over 50 Conclusions and Recommendations, providing guidance to (prospective) Contracting Parties on a wide range of issues relating to the practical operation of the 1993 Adoption Convention, including the prevention of illicit practices, post-adoption matters, intrafamily adoptions and alternatives to full adoption, technical assistance and the use of technology. On 27 July 2022, the HCCH and the Asian Business Law Institute co-hosted the webinar “Cross-border Commercial Dispute Resolution – HCCH 2005 Choice of Court and 2019 Judgments Conventions”. More information is available here.

 

Upcoming Events

The inaugural CODIFI Conference will be held online from 12 to 16 September 2022. CODIFI will examine issues of private international law in the Commercial, Digital, and Financial (CODIFI) sectors, highlighting developments in the digital economy and fintech industries as well as clarifying the roles of core HCCH instruments: the 1985 Trusts Convention, the 2006 Securities Convention, and the 2015 Choice of Law Principles. HCCH Monthly Update: June 2022

Conventions & Instruments

On 4 June 2022, the HCCH 1961 Apostille Convention entered into force for Indonesia. The Convention currently has 122 Contracting Parties. More information is available here.

On 22 June 2022,  the Philippines deposited its instrument of ratification of the HCCH 2007 Child Support Convention. With this ratification, 44 States and the European Union are now bound by the Child Support Convention. It will enter into force for the Philippines on 1 October 2022. Meetings & Events

On 1 and 2 June, the HCCH Regional Office for Latin America and the Caribbean organised a judicial training on the HCCH 1980 Child Abduction Convention in partnership with the Judicial School of Bolivia.

On 23 and 24 June, the HCCH participated in the Conference on Conflicts of Jurisdiction organised by the Journal of Private International Law and the Singapore Management University. More information is available here.

On 30 June and 1 July, the HCCH participated in the Regional Forum “HCCH 2019 Judgments Convention: Prospects for the Western Balkans”, organised by the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) and the Center for International Legal Cooperation. On 9 March 2022, the Permanent Bureau announced the launch of the post-event publication of HCCH a|Bridged – Edition 2021, focused on contemporary issues relating to the application of the 2005 Choice of Court Convention, including the promotion of party autonomy. On 9 March 2022, the Permanent Bureau published the results of the 2022 survey for arbitration institutions on the 2015 Principles on Choice of Law in International Commercial Contracts. More information is available here.

On 16 March 2022, the Permanent Bureau of the HCCH published an Information Note on the subject of “Children deprived of their family environment due to the armed conflict in Ukraine: Cross-border protection and intercountry adoption”. More information is available here.

CEDEP’s Choice of Law online course is now open to the public, featuring an introductory lecture on the Legal Guide to Uniform Instruments in the Area of International Commercial Contracts, with a Focus on Sales, published year by the Secretariats of UNCITRAL, UNIDROIT and the HCCH. Meetings & Events

On 1 December 2021, the HCCH hosted HCCH a|Bridged – Edition 2021, an online event focused on contemporary issues relating to the application of the HCCH 2005 Choice of Court Convention, including the promotion of party autonomy. More information is available here.

On 6 and 7 December 2021, the HCCH Administrative Cooperation Working Group on the 2007 Child Support Convention met via videoconference. The Group continued its work as a forum for discussion of issues pertaining to administrative cooperation, discussing in particular the collection of statistics under the Convention. On 10 December 2021, the HCCH hosted a virtual seminar on the HCCH 2005 Choice of Court Convention and the HCCH 2019 Judgments Convention for the Supreme Court of Ukraine. This was the third of a series of seminars, organised with the generous support of the EU Project Pravo-Justice, aimed at facilitating the proper and effective implementation of the HCCH Conventions and instruments in Ukraine.

Publications and Documentation

On 9 December 2021, the Permanent Bureau announced the publication of translations, in Arabic, Chinese, Russian and Spanish, of the Legal Guide to Uniform Instruments in the Area of International Commercial Contracts, with a Focus on Sales. With these new translations, the Legal Guide is now available in all UN languages. More information is available here.

On 14 December 2021, the Permanent Bureau announced the publication of 21 new translations of the Guide to Good Practice on the Use of Video-Link under the Evidence Convention. With these new translations, the Guide to Good Practice is now available in 23 European Union languages. More information is available here.

HCCH Monthly Update: November 2021

Conventions & Instruments

On 17 November 2021, the Russian Federation signed the HCCH 2019 Judgments Convention. Although the 2019 Judgments Convention is not yet in force, the Russian Federation is its fifth signatory. The Russian Federation has been a Member of the HCCH since 2001 and is a Contracting Party to six HCCH Conventions. More information is available here.

Meetings & Events

On 5 November 2021, the HCCH hosted a virtual seminar on the HCCH 1980 Child Abduction Convention and the HCCH 1996 Child Protection Convention for the Supreme Court of Ukraine. This was the second of a series of seminars, organised with the generous support of the EU Project Pravo-Justice, aimed at facilitating the proper and effective implementation of the HCCH Conventions and instruments in Ukraine. On 8 November 2021, the HCCH Working Group on Preventing and Addressing Illicit Practices in Intercountry Adoption met via videoconference. The Group continued to work on the development of a Toolkit aimed at preventing and addressing illicit practices in intercountry adoptions made under the HCCH 1993 Adoption Convention. From 15 to 19 November 2021, the HCCH Experts’ Group on Parentage / Surrogacy met via videoconference. The Group discussed the form, structure and focus of the final report that is to be presented to the Council on General Affairs and Policy of the HCCH at its 2023 meeting. From 22 to 25 November 2021, the HCCH participated in the 24th International Congress of the International Union of Judicial Officers. Secretary General Dr Christophe Bernasconi participated in the panel discussion “Cyber Justice: New Opportunities for the Judicial Officer” and in the roundtable discussion “Cyber Justice – The future of our profession – Evolution or Revolution?”, while Senior Legal Officer Dr Ning Zhao delivered a presentation on the HCCH 2019 Judgments Convention. Dr Zhao’s accompanying article “The HCCH 2019 Judgments Convention – adding essential components for an effective international legal framework on recognition and enforcement” will be published in the proceedings of the Congress. Upcoming Events

HCCH a|Bridged Edition 2021 will be held online on Wednesday, 1 December 2021. This year’s edition will discuss contemporary issues relating to the application of the HCCH 2005 Choice of Court Convention, including the establishment of international commercial courts around the globe and how it enables party autonomy.
