A few takeaways from the Conclusions & Decisions of the HCCH governing body (CGAP – 2026 meeting): parentage/surrogacy, jurisdiction project, cross-border recognition and enforcement of protection orders and a Note on the Trusts Convention

This week the Conclusions & Decisions (C&D) of the HCCH governing body, the Council on General Affairs and Policy (CGAP or Council), were published. Click the links below for the relevant language versions (English, French and Spanish).

Although a wide range of topics were discussed, I would like to focus on four items: parentage/surrogacy project, the cross-border recognition and enforcement of protection orders, the jurisdiction project and a Note on the Trusts Convention.

In my view, the C&D are significant for two reasons. First, the work related to a possible new instrument of a long-standing topic at the HCCH has been concluded (without a Convention) and secondly, a “new” topic has been inserted into the agenda of the HCCH. Children-parents in the EU: Stakeholders’ meeting 13 and 14 March

The Unipar project partners are organising a stakeholders’ meeting on the EU’s proposal on filiation/parenthood, domestic private international law, human and children’s rights, and EU law. The meeting will be held in Brussels on 13 and 14 March, and will be livestreamed for persons who wish to follow.

The programme is available on the Unipar website. There you will also find the registration link for online participation.

Unipar is co-funded by the European Union. It is a two-year project that comments on the EU’s proposal on private international law on filiation, but also investigates the larger context of filiation/parenthood across borders. The first outcome is a report on the impact on parentage of the EU acquis.

Meetings & Events

From 8 to 12 April 2024, the Working Group on Parentage / Surrogacy met for the second time. Pursuant to its mandate, the Working Group continued its consideration of draft provisions for one new instrument on legal parentage generally, including legal parentage resulting from an international surrogacy agreement. Conventions & Instruments

On 1 November 2023, Canada deposited its instrument of ratification of, and Kyrgyzstan its instrument of accession to, the 2007 Child Support Convention. At present, 48 States and the European Union are bound by the Convention. More information is available here.

HCCH Monthly Update: April 2022

Conventions & Instruments

On 8 April 2022, the Kingdom of Saudi Arabia deposited its instrument of accession to the HCCH Apostille Convention. The Convention will enter into force for Saudi Arabia on 7 December 2022. With this accession, the Apostille Convention now has 122 Contracting Parties. More information is available here.

Meetings & Events

From 28 March to 1 April 2022, the Experts’ Group on Parentage / Surrogacy met for the eleventh time. The Group discussed the content of the final report that is to be presented to the Council on General Affairs and Policy (CGAP) at its 2023 meeting. More information is available here.

The Permanent Bureau has announced that the inaugural CODIFI Conference will be held online from 12 to 16 September 2022. CODIFI will examine issues of private international law in the Commercial, Digital, and Financial (CODIFI) sectors, highlighting developments in the digital economy and fintech industries as well as clarifying the roles of core HCCH instruments: the 1985 Trusts Convention, the 2006 Securities Convention, and the 2015 Choice of Law Principles. HCCH Monthly Update: February 2021

Conventions & Instruments

On 1 February 2021, the HCCH 1965 Service Convention entered into force for the Marshall Islands. It currently has 78 Contracting Parties. More information is available here.

On 1 February 2021, the HCCH 2007 Child Support Convention entered into force for Serbia. At present, 41 States and the European Union are bound by the Convention. More information is available here.

On 1 February 2021, the HCCH 1993 Adoption Convention entered into force for Saint Kitts and Nevis. It currently has 103 Contracting Parties. More information is available here.

Meetings & Events

From 1 to 5 February 2021, the Experts’ Group on Jurisdiction met for the fifth time, via videoconference. The discussion focused on questions of policy, including in relation to rules of direct jurisdiction, parallel proceedings, related claims, and mechanisms for judicial coordination and cooperation. From 8 to 11 February 2021, the Experts’ Group on International Transfer of Maintenance Funds met via videoconference. The Group continued its work discussing good practices and identifying possible future improvements in relation to the cross-border transfer of child support payments, with a view to facilitating the most cost-effective, transparent, prompt, efficient and accessible cross-border transfer of funds. From 15 to 17 February 2021, the Experts’ Group on Parentage/Surrogacy met for the eighth time, via videoconference. The Group discussed what the focus of its work should be at its next meeting(s) in order to prepare its final report on the feasibility of a possible future general private international law instrument on legal parentage and the feasibility of a separate possible future protocol with private international law rules on legal parentage established as a result of an international surrogacy arrangement.
