HCCH Monthly Update: May 2021

Conventions & Instruments

On 24 May 2021, Niger deposited its instrument of accession to the HCCH 1993 Adoption Convention. With the accession of Niger, the Adoption Convention now has 104 Contracting Parties. It will enter into force for Niger on 1 September 2021. More information is available here.

Meetings & Events

On 4 May 2021, the HCCH participated in the virtual launch of the book Choice of Law in International Commercial Contracts, published by Oxford University Press. The recording of the event is available here.

From 3 to 6 May 2021, the Experts’ Group on the e-APP and New Technologies met via videoconference. The Group discussed the current use of the electronic Apostille Programme (e-APP), and future solutions. It endorsed a set of key principles and good practices for Contracting Parties in the implementation of the e-APP, and invited the PB to develop an online forum to facilitate intersessional discussion and information sharing, including in relation to best practices, between meetings of the Special Commission and the International Forum on the e-APP. On 10 and 11 May 2021, the Administrative Cooperation Working Group on the 2007 Child Support Convention met via videoconference. The Group continued its work as a forum for discussion of issues pertaining to administrative cooperation, making significant progress on a Draft Statistical Report under the 2007 Child Support Convention. From 18 to 22 May 2021, the HCCH co-organised a virtual seminar for judges on adoption and the protection of the rights of children and adolescents, in collaboration with the Judiciary Council and the Ministry of Economic and Social Inclusion of Ecuador. Publications & Documentation

On 21 May 2021, the HCCH and the World Intellectual Property Organization (WIPO) launched a questionnaire on the intersection of private international law and intellectual property. The Questionnaire is open for consultation to a wide audience, including Member States of both Organisations, other intergovernmental organisations, non-governmental organisations, practitioners, in-house counsel, academics and other private individuals. Responses will be received until 30 June 2021, after which they will be compiled and analysed, with the results to be submitted to the HCCH’s Council on General Affairs and Policy (CGAP) ahead of its 2022 meeting. HCCH Monthly Update: January 2021

Membership 

On 19 January 2021, Namibia deposited its instrument of acceptance of the Statute, becoming the 87th Member of the HCCH. More information is available here. 

Conventions & Instruments  

On 1 January 2021, the HCCH 2000 Protection of Adults Convention entered into force for Belgium. The Convention currently has 13 Contracting Parties. More information is available here. 

On 1 January 2021, the United Kingdom’s new instrument of accession to the HCCH 2005 Choice of Court Convention and new instrument of ratification to the HCCH 2007 Child Support Convention entered into force. The United Kingdom has already been bound by the Choice of Court Convention since 2015 and by the Child Support Convention since 2014, by virtue of the European Union’s approval. To ensure continuity in their application following its withdrawal from the EU, the United Kingdom deposited these new instruments of accession and ratification on 28 September 2020. More information is available here. 

On 18 January 2020, Singapore deposited its instrument of accession to the HCCH 1961 Apostille Convention. With the accession of Singapore, the Apostille Convention now has 120 Contracting Parties. Singapore is the third ASEAN Member State to join the Apostille Convention. It will enter into force for Singapore on 16 September 2021. More information is available here. 

Meetings & Events 

From 22 to 27 January, the Applicable Law Working Group on the HCCH 2007 Maintenance Obligations Protocol met via videoconference. The Group provided guidance in relation to issues of applicable law arising from certain family relationships, the law applicable to preliminary / incidental questions, as well as the interpretation and scope of certain articles of the Protocol. More information is available here. 

Publications & Documentation 

On 29 January, the Permanent Bureau announced the publication of translations, in all European Union languages, of the Practical Handbook for Competent Authorities on the 2007 Child Support Convention, the 2007 Maintenance Obligations Protocol, and the 2009 EU Maintenance Regulation. The translations were made possible with the support of the Directorate-General for Justice and Consumers of the European Commission. The Handbook, originally published in English, French, and Romanian, was jointly developed by the HCCH, the Ministry of Justice of Romania, and the French National School for the Judiciary (ENM). HCCH Monthly Update: December 2020

Membership

On 4 December 2020, Mongolia was issued with a certificate confirming an affirmative vote in favour of its admission as a Member of the HCCH, following a six-month voting period which ended on 3 December 2020. Mongolia has now been invited to deposit an instrument of acceptance of the HCCH Statute to become a Member of the HCCH.

Meetings & Events

On 2 December 2020, the HCCH and the German Presidency of the Council of the European Union co-hosted the HCCH a|Bridged – Edition 2020, the focus of which was the Golden Anniversary of the HCCH 1970 Evidence Convention. More information about the event is available here.

On 3 December 2020, the HCCH and ASADIP co-hosted an International Conference on the 2019 Judgments Convention. A full recording of the event, held in Spanish, is available on the HCCH Facebook Page and the HCCH YouTube Channel (Part 1 and Part 2).

On 11 December 2020, the HCCH and UNCITRAL co-hosted a Virtual Colloquium on Applicable Law in Insolvency Proceedings. More information, including documentation and audio recordings, is available here.

From 14 to 17 December 2020, the Administrative Cooperation Working Group on the 2007 Child Support Convention met via videoconference. The Group provided guidance in relation to the development of a standard statistical report under the Child Support Convention, including the use of the iSupport case management system, and other matters such as recommended forms and country profiles. On 22 December 2020, the Permanent Bureau announced the publication of the 4th Edition of the Practical Handbook on the Operation of the Evidence Convention (Evidence Handbook). This edition commemorates the 50th anniversary of the Convention and is complemented by the Guide to Good Practice on the Use of Video-Link released earlier this year.
