A few takeaways from the Conclusions & Decisions of the HCCH governing body (CGAP – 2026 meeting): parentage/surrogacy, jurisdiction project, cross-border recognition and enforcement of protection orders and a Note on the Trusts Convention

This week the Conclusions & Decisions (C&D) of the HCCH governing body, the Council on General Affairs and Policy (CGAP or Council), were published. Click the links below for the relevant language versions (English, French and Spanish).

Although a wide range of topics were discussed, I would like to focus on four items: parentage/surrogacy project, the cross-border recognition and enforcement of protection orders, the jurisdiction project and a Note on the Trusts Convention.

In my view, the C&D are significant for two reasons. First, the work related to a possible new instrument of a long-standing topic at the HCCH has been concluded (without a Convention) and secondly, a “new” topic has been inserted into the agenda of the HCCH. Report on the 2025 Journal of Equity Conference – Equity, Trusts and Private International Law

On 21 August 2025, the UNSW School of Private and Commercial Law, the Journal of Equity and Allens jointly hosted the 2025 Journal of Equity Conference. This year’s one-day Conference focused on important questions at the intersection of equity, trusts and private international law. It featured four papers delivered by judges and scholars, each of which was followed by ample time for insightful questions and discussion among over 30 judges, lawyers and scholars attending the office of Allens in (rainy) Sydney.

HCCH Monthly Update: August 2022

Conventions & Instruments

On 29 August 2022, the European Union deposited its instrument of accession to the HCCH 2019 Judgments Convention, becoming the first Contracting Party to the Convention, and Ukraine deposited its instrument of ratification, becoming the second Contracting Party to the Convention. As a result, the Judgments Convention will enter into force on 1 September 2023 – just over four years after its adoption on 2 July 2019. More information is available here.

On 29 August 2022, Ukraine deposited its instrument of ratification of the HCCH 2007 Maintenance Obligations Protocol. The Protocol, which currently has 32 Contracting Parties, will enter into force for Ukraine on 1 December 2022. More information is available here.

Upcoming Events

The inaugural CODIFI Conference will be held online from 12 to 16 September 2022. CODIFI will examine issues of private international law in the Commercial, Digital, and Financial (CODIFI) sectors, highlighting developments in the digital economy and fintech industries as well as clarifying the roles of core HCCH instruments: the 1985 Trusts Convention, the 2006 Securities Convention, and the 2015 Choice of Law Principles. HCCH Monthly Update: July 2022

Conventions & Instruments

On 1 July 2022, the HCCH 2007 Child Support Convention and the HCCH 2007 Maintenance Obligations Protocol entered into force for Ecuador. At present, 44 States and the European Union are bound by the Convention, while 30 States and the European Union are bound by the Protocol. More information is available here.

On 8 July 2022, Pakistan deposited its instrument of accession to the HCCH 1961 Apostille Convention. The Convention, which currently has 124 Contracting Parties, will enter into force for Pakistan on 9 March 2023. More information is available here.

On 13 July 2022, Senegal deposited its instrument of accession to the HCCH 1961 Apostille Convention. The Convention, which currently has 124 Contracting Parties, will enter into force for Senegal on 23 March 2023. More information is available here.

 

Meetings & Events

From 4 to 8 July 2022, the Fifth Meeting of the Special Commission on the Practical Operation of the 1993 Adoption Convention was held online, attended by nearly 400 participants representing HCCH Members, Contracting Parties and Observers. The meeting resulted in the adoption of over 50 Conclusions and Recommendations, providing guidance to (prospective) Contracting Parties on a wide range of issues relating to the practical operation of the 1993 Adoption Convention, including the prevention of illicit practices, post-adoption matters, intrafamily adoptions and alternatives to full adoption, technical assistance and the use of technology. On 27 July 2022, the HCCH and the Asian Business Law Institute co-hosted the webinar “Cross-border Commercial Dispute Resolution – HCCH 2005 Choice of Court and 2019 Judgments Conventions”. More information is available here.
