Thank you to C. Keitner for illustrating the distinction between status-based and conduct-based immunity posted on opinioiuris in reply to D.Hollis post. We should not waste any more time in formalistic academic debate. Thinking of characterising a tentative rape as an “official act” is ridiculous if not offensive.
Let’s remind the great French motto “Liberté EGALITE’ Fraternité”; equality before the law, and the principle of innocence, of course.
